Terms & Conditions

These Terms and Conditions, together with our End User License Agreement ("EULA") and Privacy Policy, constitute a legally binding agreement between you ("User", "you", or "your") and Engr. Tarikul Islam ("Developer", "we", "us", or "our") governing your access to, download of, and lawful use of the Family Safety mobile application (the "App") and associated digital services.

By downloading, installing, accessing, or using Family Safety, you represent and warrant that you are at least 18 years of age (or have obtained verifiable legal parental or guardian authorization) and have the full legal capacity to enter into this binding agreement. If you do not agree to all provisions of these Terms unconditionally, you must immediately cease all access and uninstall the App from all your devices.

Subject to your strict and ongoing compliance with these Terms, the Developer grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and execute one copy of Family Safety solely on compatible personal mobile devices owned or controlled by you, exclusively for personal, non-commercial family safety and household coordination purposes.

CRITICAL LEGAL NOTICE: Family Safety is designed and licensed exclusively for lawful family safety and coordination based strictly on 100% voluntary mutual consent.

You expressly warrant, represent, and agree that:

Family Safety provides real-time location telemetry and automated geofenced safe zone notifications (e.g. Home, School, Work) as an auxiliary coordination tool.

You acknowledge and understand that:

IMPORTANT EMERGENCY NOTICE: The One-Tap SOS feature within Family Safety is an auxiliary digital notification tool designed to alert pre-connected circle members.

IT IS NOT A CERTIFIED EMERGENCY DISPATCH SERVICE OR A REPLACEMENT FOR CALLING PROFESSIONAL LAW ENFORCEMENT, FIRE BRIGADE, AMBULANCE, OR NATIONAL EMERGENCY RESCUE OPERATORS (E.G., 999, 911, 112).

You are solely and fully responsible for any messages, text, media, event broadcasts, notes, or entries you transmit, store, or share via Family Safety.

You agree that you will NOT transmit or share any content that:

The App provides a Multi-Calendar system (supporting Bangla, English, and Arabic / Hijri formats), Collaborative Notes, and a Personal Budget tracker for convenience.

All budget calculations, calendar alarms, and shared notes are provided for personal informational reference only. The Developer does not provide financial, legal, or medical advice and assumes no liability for missed calendar events, scheduling errors, or financial calculations. You are advised to maintain independent backups of critical records.

To perform its safety capabilities, Family Safety requires device hardware access, including Precise Location (Foreground & Background), Camera (strictly for dynamic QR scanning), Push Notifications, and Vibration motor control.

You acknowledge that denying or revoking any necessary runtime permission may disable or severely impair core features such as real-time tracking, safe zone triggers, and SOS alerts.

The App relies on integration with reputable third-party infrastructure, including Google Maps SDK (for mapping and geocoding), Google Play Services, and Firebase Cloud Messaging (for push notifications).

Your use of mapping and platform features is subject to the respective terms and service availability of Google LLC. The Developer is not liable for temporary service interruptions, API rate limits, or platform outages originating from third-party SDK providers.

All right, title, and interest in and to Family Safety, including but not limited to source code, algorithms, visual UI designs, animations, logos (including ICON.png), brand marks, graphics, database schemas, and documentation, are the sole and exclusive proprietary intellectual property of Engr. Tarikul Islam, protected under international copyright, trademark, and trade secret treaties.

Nothing in these Terms grants you any right, title, or interest in our trademarks, trade names, or proprietary technologies beyond the limited revocable license explicitly provided herein.

TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE APPLICATION, ITS FEATURES, AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

THE DEVELOPER SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, TIMELINESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE OPERATION OF Family Safety WILL BE UNINTERRUPTED, TIMELY, SECURE, ACCURATE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE IMMEDIATELY CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL ENGR. TARIKUL ISLAM, HIS AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF LIFE, PERSONAL INJURY, EMOTIONAL DISTRESS, LOSS OF DATA, LOSS OF PROFITS, DEVICE DAMAGE, UNAUTHORIZED DATA ACCESS, OR SERVICE INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE APP.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE DEVELOPER FOR ALL CLAIMS ARISING UNDER OR RELATING TO THESE TERMS EXCEED THE EXACT AMOUNT PAID BY YOU TO THE DEVELOPER FOR THE APP DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM (OR $0.00 IF THE APP WAS PROVIDED FREE OF CHARGE).

You agree to defend, indemnify, and hold harmless Engr. Tarikul Islam, his contractors, and service providers from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or legal fees (including reasonable attorneys' fees) arising out of or relating to:

We reserve the absolute right to suspend, restrict, or permanently terminate your access to Family Safety at any time, with or without notice, if you breach these Terms or engage in abusive conduct.

You may terminate your account at any time by navigating to Settings -> Account Settings -> Danger Zone -> Delete Account directly inside the mobile app, or by submitting a formal web request through our Account Deletion portal. Upon account deletion, all your profile data and circle linkages will be permanently purged.

These Terms and any dispute or claim arising out of or in connection with them shall be governed by, construed, and enforced in accordance with the substantive laws of Bangladesh, without regard to its conflict of law principles.

Any legal action, suit, or proceeding arising under these Terms shall be instituted exclusively in the competent commercial and civil courts located in Dhaka, Bangladesh, and you irrevocably submit to the exclusive personal jurisdiction of such courts.

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
